A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.

In her decision, the judge noted that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The court challenge center on disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.

The court, who was hearing his petition to removal in a federal court, determined that he must now comply with the conditions of his release from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
